Definitions

In these terms and conditions "Dicha", "we", "our", "us", means Dicha Ltd (company number 6818595), whose registered address is at Suite 102, Signal House, Harrow, Middlesex HA1 2AG. User" and "you" means any user of the Website including any user who makes a purchase through the Website (a "Buyer").

Online Shopping

Dicha has taken every effort to display the re-worked vintage jewellery as accurately as possible. Images and colours may vary as shown according to the monitor they have been displayed on. We are therefore unable to guarantee that the product images are an accurate representation of the actual merchandise. Crystal, being very sparkly, can sometimes not photograph at its best and relies on the movement of the crystal to catch and reflect the light. 

Please refer to our Returns Policy if you are unhappy with your purchase. We will not be liable if for any reason the Dicha website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of the Dicha website.

Formation Agreement

An agreement governing your use of the Website, all stages of the process and our sale of items when we receive confirmation of your order is made on the basis of these Terms and Conditions. This agreement between us is referred to in these Terms and Conditions as the ‘Agreement’. We reserve the right to change any part of this agreement without notice and at our sole discretion. The Terms and Conditions in force at the time an order is confirmed will govern any particular order and we recommend that you print a copy of these terms and conditions. You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us, our officers, directors, employees, agents and suppliers arising from any infringement of the Terms and Conditions set out in this agreement.

Use of the Website

You use this Website at your own risk. You agree that you will be personally liable for your use of the Website and for all your communications and activity on the Website. By using this site you agree to comply with, and be bound by, our Terms and Conditions.

Before placing an order, if you have any queries relating to the Terms and Conditions please email our head office team at info@dicha.co.uk You may not use this website for any commercial purpose.

We feature products on our website that have been carefully selected for sale on the Dicha website. Once an item is sold out it will be taken off the website at the earliest opportunity and may not be available again. Prices of products may change from time to time. Goods are subject to availability. As there is a delay between the time when your order is placed, and the time when the order is accepted, the stock position relating to any particular item may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items.

Registration

You are able to navigate through the Website without going through a registration process but we require you to complete the ‘my account’ form to become a registered member before an order can be made through the Website. During the registration process, you must choose a username and password. You are responsible for all actions taken under that username and password and must only purchase from dicha.co.uk under your own username and password. You must make every effort to keep your password safe and should not disclose it to anyone. If you think that someone else might know it you must change it.

You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password. You will remain liable if someone else uses your shopping account and /or personal information unless you can prove that such use was fraudulent. If there are any changes to the details supplied by you it is your responsibility to inform Dicha as soon as possible.

Privacy and Communications

We respect your concerns about privacy. We, therefore, encourage you to refer to the privacy policy of the Website (the "Privacy Policy"). To fulfill our obligations to you under these Terms and Conditions we communicate with you by e-mail. You agree to receive communications from us electronically in this way. You also agree that electronic communications will satisfy any legal requirement for communications to be in writing.

Placing an Order

You warrant that all details you provide to dicha.co.uk for the purpose of ordering or purchasing goods are true, accurate, current and complete in all respects and that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered.  Anyone caught deliberately entering an incorrect or fictitious order will be prosecuted to the fullest extent of the law. Buyers must be over the age of 18 years and have full legal capacity. Orders shall be accepted at our sole discretion but are normally accepted if the item(s) is/are in stock, we are able to obtain authorisation for your payment and the order reflects current pricing. If we are unable to fulfill your order following our order acknowledgement, we will contact you by email or telephone advising you of this. Where the order is for multiple items the rest of the order will remain valid. Order process

All orders that you place on this website will be subject to acceptance in accordance with these Terms and Conditions. Non-acceptance of your order may be due to any one or more of the following non-exhaustive reasons:
The product you ordered is out of stock;
Our inability to obtain authorisation for your payment;
We have identified a pricing or product description error;
There is a failure to meet the eligibility to order as set out in these Terms and Conditions;
There is a system or procurement failure;
Failed customer validation checks.
When you place an order on our website we shall email you an acknowledgement detailing the product you have ordered. This email is not an order confirmation or order acceptance from Dicha.

Acceptance of your order and the completion of the contract between you and Dicha will take place when your order is dispatched: We will email you that your order has been dispatched. We reserve the right to dispatch multiple orders separately.

Pricing and payment

All products are priced in pounds sterling (£GBP) and are inclusive of VAT (where applicable) at the current rate. The total cost of the order is the price of the products plus the delivery charge which will be indicated to you during the ordering process. The actual price charged to overseas customers will be subject to the exchange rate applied by the customer's credit or debit card company. Customers outside the United Kingdom will also be liable for any import duty, quotas, permits, product restrictions and other local requirements. You are advised to check the latest applicable local requirements before placing an order. Prices may change at any time. Although we try to ensure all our prices displayed on our website are accurate, errors may sometimes occur. If we discover an error in the price of an item you have ordered we will contact you as soon as possible. You will have the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled.

Orders are processed online using a valid credit or debit card of the type that we accept for purchases. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses, or subsequently refuses to, or does not, for any reason authorise payment to us, we will not be liable for any delay or non-delivery. If you have paid on your debit, credit or charge card you will be charged prior to the goods being dispatched to the delivery address. We will email you to confirm dispatch.

We retain the legal ownership of the Products until full payment has been made by you and such payment has been received by us. Legal ownership of the Products will immediately revert to us if we refund any such payment to you. Risk in the Products will pass to you on delivery to you.

Payment Methods

We only accept payment for orders in pound sterling (£GBP). We accept payment by American Express, Maestro, MasterCard, Visa, Visa Debit and Dicha credit note. If you choose to pay for an item using a payment card with a foreign currency denominated account, the account will still be taken in pounds sterling (£GBP) at the conversion rate applied by the relevant payment scheme at the time of processing your order. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your purchase and payment secure, but, in the absence of negligence on our part, we will not be liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Dicha website.

Intellectual Property

All intellectual property of Dicha, such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the Website remain the property of Dicha Ltd. dicha.co.uk is for your personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer or sell any content, software, products or services contained within dicha.co.uk. You may not use dicha.co.uk or any of its content to further any commercial purpose, including any advertising or advertising revenue generation activity on your own site.

Third Parties

The Website may contain hyperlinks to Websites operated by other parties. We do not control such Websites and we take no responsibility for, and will not incur any liability in respect of their content. Your linking to or from any off-Website pages or other Websites is at your own risk. Our inclusion of hyperlinks to such Websites does not imply any endorsement of views, statements or information contained in such Websites. We are not responsible or liable for any loss or damages of any sort incurred as a result of dealings with or the presence of off-Website links on the Website. We are also not responsible for any malfunctions which may occur during any linking to our Website from any third party website or from our Website to any third party website.

Liability

If you have a valid claim in respect of any of the items which is based on any defect or their failure to meet specification in accordance with this agreement, we shall replace the items (or the faulty piece in question) free of charge or refund to you the price of the item.

We shall not be liable to you in connection with this agreement in contract, tort (including negligence) or otherwise for any loss arising from a cause which is out of our control, any internet, network or virus problem, for any loss of profit, anticipated savings or data (in each case whether direct or indirect) and/or any indirect loss.

Our aggregate liability to you in connection with this agreement shall not exceed the value of the items ordered by you. Notwithstanding anything else in these Terms and Conditions, we accept unlimited liability in respect of death or personal injury caused by our negligence.

Severance

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.

Governing Law and Jurisdiction

This Agreement will be governed by the laws of England & Wales and any user of the Website hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.

Privacy Policy

References in this Privacy Policy to "we", "us" and "Dicha" are to Dicha Ltd. We respect the privacy of our online visitors and recognise the importance of protecting the information collected about you. We will use the information we collect about you carefully, lawfully and in accordance with all applicable UK data protection legislation. Should our Privacy Policy change in the future, we will post these changes to our Website. Please check back frequently on the Website to see any updates or changes to our Privacy Policy.

When a purchase is made we ask for your name, telephone number, e-mail address, delivery address, shipping address and payment method details. This information will be used to process the order, payment, fulfill/deliver your order and manage your account. We may use your information for the purpose of prevention and detection of fraud. We do not store your financial details (credit or debit card numbers). We may obtain information about your usage of our Website to help us develop and improve it further.

From time to time, we may also send information about products and services and details of promotions and special offers from Dicha. If you do not wish to be contacted for marketing purposes or you do not wish for us to share your details with any third parties, you may unsubscribe by sending an e-mail to us at unsubscribe@dicha.co.uk

Please ensure that you read the privacy policies of such other companies or organisations before submitting any of your personal information to them.

Cancellations

As it is our policy to try to process orders immediately it may not always be possible to stop an order from being dispatched. After dispatch our Returns Policy will apply. This does not apply to faulty or incorrectly supplied goods where your statutory rights are unaffected.

Returns Policy

Your rights to return goods are protected under the Consumer Protection (Distance Selling ) Regulations 2000. If you wish to return an item/s, we ask that you complete a return form, which can be accessed at http://www.dicha.co.uk/ account.php?action=view_orders, or email info@dicha.co.uk with the following details: Order ID, full name, address and the item(s) you wish to return. Items should be returned in their original condition, unused, in the original packaging (for protection), with tags still attached, to the address on the invoice. No Returns can be accepted on earrings for health and hygiene reasons. Provided that you have correctly followed the procedures indicated above, we will exchange or provide a credit note for any other item you are not completely happy with, within 7 working days of the item being delivered to your nominated address. 

We will not accept back any item(s) for exchange or credit with any indication that it has been used. In such cases, the item(s) will be returned to the customer and no exchange or credit note will be issued. Please ensure that all returns for any particular order are returned in one shipment. Any subsequent returns from the same order may incur additional shipping costs.

In certain circumstances, items received outside of this time frame may be accepted by us as a return, but this will be at our sole discretion.

Please note that any items being returned remain your responsibility until they are received by us, as we do not accept any responsibility for items lost in transit. Therefore, for your own peace of mind and protection, we recommend that our UK customers return all items using a trackable service, i.e. Royal Mail Special Delivery. We advise our International customers to use a registered mail carrier or tracking service for their return.

Making an Exchange

If you would like to exchange an item, please specify your preferred item on the returns note. Please note that the replacement item is not guaranteed. There will be an additional delivery charge for any items that are dispatched for an exchange.

A credit will be issued for the returned item and you will need to place a new order for the replacement item/s on our website.

Exchanged items will be dispatched to you as soon as the returned items have been received, undergone a quality control test, and any additional payment that may be required has been made.

If you are exchanging an item because of a mistake on the part of Dicha, we will pay the shipping cost to send a replacement to you. In this instance, please either email customer services at info@dicha.co.uk or call our customer services team Monday to Friday, 9am to 5pm, on 0207 402 5884 before you return the item(s).

Delivery Information

For All UK orders:
Deliveries may be made in one of the following ways :

UK Mainland
Royal Mail Special Delivery - £10.00 including postage and packaging.

All orders placed before 12:00 noon Monday to Friday will be dispatched the same day using the Royal Mail Special Delivery service and should be received before 1pm the following day. Orders placed after 12:00 noon will be dispatched the next working day. Orders placed after 12:00 noon on Friday or anytime on Saturday or Sunday will be dispatched on the following Monday.

A signature is required upon delivery. If there is no one to sign for the package you will be left a card to arrange re-delivery or asked to pick up the package from the nearest Royal Mail or courier depot within 7 days of receiving notification from the postal service. If you do not follow the re-delivery instructions, the package will be returned to us. In these circumstances, you will be required to pay for re-delivery before we can re-dispatch your parcel.

Before completing your order with us, please check that you have supplied us with the correct billing and shipping address. All paperwork and labels will be printed exactly as typed by you in the billing/shipping address box and any errors may result in failure to deliver.

European Address
Royal Mail Airmail with International Signed ForTM - £20 including postage and packaging

This is a signed for service and should take up to 3-4 working days for delivery. Occasionally external factors beyond our control may cause some delay.

A signature is required upon delivery. If there is no one to sign for the package you will be left a card to arrange re-delivery or asked to pick up the package from your local post office within 7 days of receiving notification from the postal service. If you do not follow the re-delivery instructions, the package will be returned to us. In these circumstances, you will be required to pay for re-delivery before we can re-dispatch your parcel.

Worldwide Address
Royal Mail Airmail with International Signed for TM - £25 including postage and packaging

This is a signed for service and should take up to 5 working days for delivery. Occasionally external factors beyond our control may cause some delay.

A signature is required upon delivery. If there is no one to sign for the package you will be left a card to arrange re-delivery or asked to pick up the package from your local post office within 7 days of receiving notification from the postal service. If you do not follow the re-delivery instructions, the package will be returned to us. In these circumstances, you will be required to pay for re-delivery before we can re-dispatch your parcel.

General Shipping Information

Please note that delivery times are provided as guidelines only, and do not take into account possible delays caused by payment authorisation, address verification or order processing. Your order will only be dispatched once payment authorisation and address verification have been received.

Delivery schedules are estimated to the best of our ability, and actual delivery times may vary depending on shipping locations & carriers. Whilst we use all reasonable endeavours to meet the timescales given to you, occasionally external factors may cause unforeseen delays. Therefore, please ensure that you make your order with enough lead-time to prevent any loss or disappointment resulting from the delivery time as we cannot be responsible for this.

Overseas customers are responsible for paying any local import taxes or duties levied on goods delivered from the UK. Please be aware that collection of such charges by an overseas Customs authority may result in a delivery delay.

Insurance

Please note that all items are insured against theft and accidental damage whilst in transit from Dicha to the shipping address. Once the items have been delivered and signed for, they are no longer covered by our insurance. In the rare event that your package is damaged upon arrival, you should either refuse the delivery, or make a note when signing for it that you are accepting a damaged package and detail the extent of the damage on the paperwork you sign.

Multiple Shipments

Please note that we are only able to ship to one address per order. If you wish to place orders for different delivery addresses, you will need to put one order on for each address required.
